Privacy Policy
1. Introduction
Welcome to Designa. We are committed to protecting your privacy and handling your data in an open and transparent manner. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website designa.ai, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the Site.
2. Information We Collect
We may collect personal information that you voluntarily provide to us when you register on the Site, express an interest in obtaining information about us or our products and services, when you participate in activities on the Site, or otherwise when you contact us. The personal information that we collect depends on the context of your interactions with us and the Site, the choices you make and the products and features you use. The personal information we collect may include the following:
- Name and contact data (email address, phone number).
- Credentials (passwords, password hints, and similar security information used for authentication and account access).
- Payment data (data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument). All payment data is stored by our payment processor and you should review its privacy policies and contact the payment processor directly to respond to your questions.
- Usage data (information about how you use our services, such as access dates and times, features used, app crashes, and other system activity).
- Content you create or upload (the descriptions and instructions you type, the images and other files you upload, and the images, video, audio and documents Designa generates for you).
- Information from connected AI assistants. If you use Designa through an AI assistant such as ChatGPT, Gemini or Meta Muse, we receive only the requests the assistant sends to Designa on your behalf (for example, your description of an image or video, the links of the pictures, reference videos or audio files to work on, a product page link, and the shape and length you asked for) and your Designa account identifier. We do not receive the rest of your conversation with the assistant.
3. How We Use Your Information
We use personal information collected via our Site for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below:
- To facilitate account creation and logon process.
- To post testimonials with your consent.
- To send you marketing and promotional communications.
- To respond to your inquiries and offer support to users.
- To enable user-to-user communications with user’s consent.
- To enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements or in connection with our contract.
- To deliver services to the user.
- To respond to legal requests and prevent harm.
4. Disclosure of Your Information
We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance. We may also share your information to comply with laws, to enforce our Site policies, or to protect ours or others' rights, property, or safety. We do not sell or rent your personal information to third parties.
We share information with the service providers that help us run Designa: Google Cloud (hosting and storage), Stripe (payments), SendGrid (email), Google Analytics and Microsoft Clarity (analytics), and the AI providers named in the next section.
When you connect Designa to an AI assistant, the assistant's provider handles your conversation under its own privacy policy. If you ask the assistant to use your brand kit or to check your credits, Designa sends it the details it asks for: your brand kit's business description, products, competitors, brand voice, colours, fonts and links to your logos and photos, and your credit balance. The assistant's provider then handles that information under its own privacy policy. We use the information we receive through a connector only to provide, maintain and support the Service for you. We do not sell it or use it to train AI models.
5. How We Use AI Providers
To create and edit content, Designa sends your descriptions and the images you ask us to work on to AI model providers that process them on our behalf. These are Google (Gemini, Veo and Lyria models), OpenAI, and, through the Replicate platform, ByteDance (Seedance) and Stability AI (Stable Audio). Images created or edited through the Meta Muse, ChatGPT and Gemini connectors use Google's Gemini image model. Videos made through those connectors use Google's Veo model or ByteDance's Seedance model, and when you give a product page link, Google's Gemini reads that page to learn what the product is.
Designa does not use your content to train AI models.
6. Where We Store Your Information and How Long We Keep It
Designa runs on Google Cloud. Our application servers and database are in the United States (Google Cloud, us-east1), and the images and files you create are stored in Google Cloud Storage in the United States. We keep your content for as long as your account is active. If you ask us to close your account or delete your data, we delete it within 30 days. We may keep payment and tax records for as long as the law requires.
Anyone who has the web address of an image you created can open it, so share image links only with people you want to see them.
7. Your Choices and Rights
You can ask us to give you a copy of your information, correct it, or delete it by emailing support@designa.ai. If you connected Designa to an AI assistant, you can disconnect it at any time in that assistant's settings.
8. Security of Your Information
We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.
9. Policy for Children
We do not knowingly solicit information from or market to children under the age of 13. If you become aware of any data we have collected from children under age 13, please contact us using the contact information provided below.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.
